Terms of service
Welcome to 20 Degree Chocolatier. Before you explore our handcrafted chocolates, we'd like to walk you through the terms that govern your relationship with us. Please read them carefully, because placing an order on our website means you accept everything set out below.
1. Who We Are
The website www.20degree.in (referred to as "the Website" or "our Platform") is owned and operated by [Legal Entity Name], a company registered in Punjab, India (referred to as "we", "us", or "our"). We are a manufacturer of premium chocolates, crafted in Punjab and delivered across India. When we say "you" or "your", we mean you as a visitor, shopper, or registered customer of our Website.
If you do not agree with these terms, our Privacy Policy, or any of our other policies, we'd ask you not to use our Platform.
2. Your Agreement With Us
By browsing our Website, creating an account, or placing an order with us, you confirm that you have read these terms and agree to be bound by them. We may update these terms from time to time, and any revision takes effect the moment we publish it here. Your continued use of our Website after we publish changes tells us you accept them, so we encourage you to check this page occasionally.
3. Eligibility
You confirm that you are legally capable of entering into a binding contract under Indian law. If you are under 18, please ask a parent or legal guardian to place the order, as they will be the contracting party and will be responsible for that order and for any breach of these terms.
If you are ordering on behalf of a company, institution, or another person, you confirm that you are authorized to accept these terms on their behalf, and both you and they accept joint responsibility under this agreement.
4. Your Account
To make your shopping experience smoother, we may ask you to register an account with us. You are responsible for keeping your login details private, and for every activity that takes place through your account. If you believe someone has accessed your account without your permission, please write to us at [your email address] right away so we can help you secure it.
You also confirm that the information you share with us, your name, phone number, delivery address, and email, is accurate and current. Incorrect details can delay your order, and we can't be held responsible for deliveries that fail because of them.
5. Our Products
Every chocolate we make is handcrafted in small batches at our facility in Punjab, using cocoa, nuts, and natural ingredients we select ourselves. Because our products are made by hand, small variations in appearance, finish, or weight are natural and are a mark of craft rather than a defect.
We photograph our chocolates as faithfully as we can, but colours may appear slightly different on your screen depending on your device settings.
Allergen notice: Our chocolates are produced in a facility that handles milk, nuts, soy, wheat, and other allergens. If you or your recipient has a food allergy, please read the product label carefully before you order, and reach out to us if you need clarification. We cannot accept liability where you have not checked the ingredient information we provide.
Hampers and gift boxes: Some items in our hampers are made in very small batches. If something becomes unavailable after you order, we may substitute an item of equal or greater value, and we will tell you when we do. The arrangement of a hamper may also be adjusted so it travels safely.
Storage: Chocolate is temperature-sensitive. Once your order reaches you, please store it in a cool, dry place away from direct sunlight and strong odours. Blooming (a pale surface film) can occur when chocolate is exposed to heat and is a cosmetic change, not a quality failure.
Shelf life: Because we work without artificial preservatives, our chocolates are best enjoyed within [X weeks] of dispatch. The best-before date is printed on every box. We guarantee quality and freshness within that window, provided the product has been stored as described on the packaging.
Heat and melting: Chocolate softens in heat, and Indian summers are demanding. We pack with insulation appropriate to the season and the destination, but once your parcel is with our courier, transit conditions are outside our control. Softening or slight misshaping in transit is not a quality failure, and chocolate that has softened can usually be firmed up again by refrigerating the sealed box for a short while. If your order arrives genuinely spoiled rather than simply soft, tell us under clause 10 and we will make it right.
6. Pricing and Payment
All prices on our Website are listed in Indian Rupees and are inclusive of applicable taxes unless we state otherwise. Shipping charges, where they apply, are shown to you at checkout before you confirm your order.
We reserve the right to revise our prices at any time. If a product is listed at an obviously incorrect price because of a technical or human error, we may cancel your order and refund you in full, even after your order is confirmed.
You can pay us through the methods offered at checkout, which may include credit cards, debit cards, UPI, net banking, and digital wallets. When you pay through a third-party payment gateway, that provider's own terms apply to the transaction, and we are not responsible for their service. Aside from the order total shown at checkout, you should never be asked to pay any additional amount to a delivery partner or anyone else.
7. Orders and Confirmation
Your order is an offer to buy from us. It becomes a confirmed contract only when we accept it and send you an order confirmation by email or SMS. Until then, we may decline or cancel your order for reasons including:
- The item you ordered is no longer available.
- We are unable to reach you to verify your order details.
- Your delivery address falls outside the areas we currently serve.
- We suspect the order is fraudulent, is intended for resale, or violates these terms.
- Circumstances beyond our reasonable control prevent us from fulfilling it, including natural events, extreme weather, transport disruptions, strikes, or government restrictions.
If we cancel an order you have already paid for, we will refund the full amount to your original payment method.
8. Cancellations and Changes
Because we craft our chocolates fresh and dispatch them quickly, we can only accommodate cancellation or change requests before your order has been processed for dispatch. Once your order has left our facility, we are unable to cancel or modify it. If you need to make a change, please contact us at the earliest at [your email address] or [your phone number] and we will do our best to help.
For any refund we approve, we will process it to your original payment method within [X] business days, though your bank may take additional time to reflect it.
9. Shipping and Delivery
We deliver across India through our courier partners. Delivery timelines shown at checkout or in your confirmation are estimates, and we cannot guarantee them, since transit times depend on your location and factors outside our control.
Please ensure someone is available to receive your order at the address you provide. If delivery fails because the address was incomplete, no one was available, or the recipient refused the parcel, the order will be treated as delivered and you remain liable for payment. In such cases, re-delivery may attract additional charges.
Risk in your order passes to you once we hand the parcel to our courier partner. We remain responsible for packing your order correctly and for what we can control, and clause 10 sets out what to do if something arrives wrong.
Sending chocolate as a gift? If you ask us to deliver to someone else, you remain our customer. That means you are the one who pays, the one we contact about the order, and the one we refund if a refund is due. Please make sure your recipient is expecting the parcel, and do let us know if they have a food allergy.
Our full shipping details are set out in our Shipping Policy, which forms part of these terms.
10. Damaged or Incorrect Orders
We want every box you receive to arrive in perfect condition. If your order reaches you damaged, incomplete, or incorrect, please notify us within 48 hours of delivery at [your email address], and share clear photographs of the outer packaging, the inner packaging, and the product itself. We may ask you to retain the product and packaging while we review your claim. Claims raised after 48 hours are difficult for us to assess fairly, and we may not be able to honour them.
Since our chocolates are perishable food items, we are unable to accept returns or exchanges on grounds of taste preference, change of mind, or delayed consumption. This does not affect any rights you have under Indian consumer protection law.
We will complete our review and let you know the outcome within [X] business days, and offer a suitable resolution, which may include a replacement or a refund. Where we approve a refund, we process it as set out in clause 8.
11. Promotional Codes and Offers
Where we run promotions, the following applies unless we say otherwise:
- Discount codes are valid only on orders placed through our Website.
- They cannot be applied retrospectively to orders you have already placed.
- They cannot be combined with any other offer or promotion.
- Each code carries its own validity period, minimum order value, and product exclusions.
- We may withdraw or modify any promotion at any time, and we may cancel orders where we detect misuse of a code.
12. Intellectual Property
Everything you see on our Website, our recipes, product names, photographs, packaging designs, illustrations, written content, our logo, and our slogan "Crafted in Punjab" — belongs to us or is used by us with permission. It is protected under Indian copyright, trademark, and design law.
You may browse our Website and share our content for your own personal, non-commercial use. You may not copy, reproduce, republish, modify, distribute, or commercially exploit any part of it without our written consent. Doing so infringes our rights and we will act to protect them.
13. How You May Use Our Website
We ask that you use our Platform lawfully and respectfully. You agree that you will not:
- Use our Website for any purpose that is unlawful or prohibited under Indian law.
- Impersonate another person or misrepresent your identity.
- Attempt to gain unauthorised access to our systems, accounts, or data.
- Introduce viruses, malicious code, or anything that could disrupt our Website.
- Extract, scrape, or harvest our content through automated means.
- Purchase our products for resale without a written distribution agreement with us.
We reserve the right to suspend or terminate your access if we believe you have breached any of the above.
14. Reviews and Content You Share
If you post a review, photograph, or comment on our Website or tag us on social media, you grant us a non-exclusive, royalty-free licence to use, reproduce, and display that content in our marketing, on our Website, and across our channels, with credit where appropriate. You confirm that the content is your own, is accurate, and does not infringe anyone else's rights. We may remove content we consider offensive, misleading, or inappropriate.
15. Third-Party Links
Our Website may link to other websites we don't control. We share these links for your convenience only, and we do not endorse or take responsibility for their content, products, or privacy practices. If you follow such a link, you do so at your own discretion.
16. Disclaimers
We provide our Website and our services on an "as is" and "as available" basis. While we work hard to keep everything accurate and running smoothly, we cannot promise that our Website will always be uninterrupted, error-free, or entirely secure, or that the information on it is complete at every moment. Nothing on our Website is intended as medical, dietary, or nutritional advice.
17. Limitation of Liability
To the fullest extent permitted by Indian law, our total liability to you in connection with any order will not exceed the amount you paid us for that order. We will not be liable for indirect, incidental, or consequential losses, including loss of profit, loss of opportunity, or missed occasions arising from a delayed delivery.
Nothing here limits our liability where the law does not permit us to do so.
18. Force Majeure
We will not be considered in breach of these terms if we are prevented from fulfilling our obligations by events beyond our reasonable control. These include natural disasters, fire, flood, epidemics, war, civil unrest, strikes, courier failures, power outages, and restrictions imposed by any government or authority.
19. Communication From Us
By sharing your contact details with us, you agree to receive order updates and service messages from us by SMS, WhatsApp, email, and phone. You may also receive offers and news from us, and you can unsubscribe from marketing communications at any time by using the link in our emails or by writing to [your email address]. Please note that transactional messages relating to your order will continue regardless.
20. Privacy
When you shop with us, we collect information such as your name, contact details, delivery address, and payment details. How we collect, store, use, and protect your data is explained in our Privacy Policy, which you should read alongside these terms.
21. Conflict Between Policies
If anything in these Terms and Conditions conflicts with another policy on our Website, these terms will take precedence, unless we have expressly stated otherwise.
22. Governing Law and Jurisdiction
These terms are governed by and interpreted in accordance with the laws of India. Any dispute between us will fall under the exclusive jurisdiction of the courts at Punjab.
